Summary: ABSTRACT
The present work seeks the perception and understanding of the legal field of which
judicial police operators, the Homicide and Victims Protection Office, the capital of
Espírito Santo, are part and act. For this, besides the valuable contribution of field
theory - to understand the field of administration of conflicts in Brazil - and habitus of
Pierre Bourdieu, it was necessary to know and apply an evolutionist construction of
the legal phenomenon within the theoretical framework of Philippe Nonet and Philip
Selznick who seeks his understanding in three basic ideal types of Law that succeed
each other in time. In addition, the understanding of the role of violence - in its varied
meanings - in the Brazilian social context that goes back to a criminalizing program of
a mass of excluded people and the benefits to a dominant elite - a political-criminal
choice that even determines the course of the judicial police. After these
considerations, began a movement of immersion in the aforementioned field of
research: via police station of homicide and protection to the person of Vitória as the
main locus of methodological action. A methodological mix was adopted for the
understanding of this closed and peculiar mesh that is the police institution and to
know, under the scientific eye, the professional action in the investigation of
homicides of the capixaba capital. Thus, we sought empirical analysis, primarily, in
harmony with theories within the interdisciplinary axis Sociology and Law answering
the question: Does the investigative police practice in the capital capixaba tendency
to an legalist reality or response to the yearnings of democratic society? The
research is confronted with the dominant and emerging tensions in the legal field.
